DC allowed the dead father to have child posthumously

The Delhi High Court enabled the deceased man to have a child posthumously by ordering the hospital to release the frozen sperm of that man and give it to his parents for posthumous reproduction. The Bench noted that there is no prohibition on posthumous reproduction, provided the consent of the sperm or egg owner was proven. It also said that semen is a genetic material and constitutes property, thus parents who are the heirs of the deceased were entitled to have access to the sample. The hope of the parents to continue the legacy cannot be defeated.
