Gambling Laws in India

Introduction

Gambling has been a part of Indian society for centuries. Traditional games involving betting, wagering and monetary stakes have existed in different forms across the country. However, the legal treatment of these in India has never been entirely uniform. The regulatory framework depended on the constitutional provisions, central legislation, State-specific laws and judicial decisions.

The legal position of these laws became more important and complicated with the growth of the internet. Now, online gaming platforms, fantasy sports, poker platforms, betting websites and mobile applications have taken over physical gambling and betting, as it is now accessible to everyone and from anywhere; any individual can participate in gaming virtually, which causes new concerns about jurisdiction, enforcement, taxation, consumer protection and the distinction between games of skill and games of chance.

The traditional legal framework was substantially influenced by the Public Gambling Act, 1867, a colonial-era legislation dealing with public gambling and common gaming houses; nevertheless, the emergence of online games required a regulatory approach to deal with the activities that occur within states or outside the jurisdiction of India.

A major development occurred with the enactment of the Promotion and Regulation of Online Gaming Act, 2025, which establishes a national framework for online gaming and specifically prohibits online money games. The legislation came into force on 1 May 2026.

Constitutional Framework Governing Gambling

The Constitution of India provides the starting point for understanding gambling legislation.

Under Entry 34 of List II (State List) of the Seventh Schedule, “betting and gambling” falls within the legislative competence of State Legislatures.

The State-specific nature of gambling regulation has helped in non-uniform regulatory framework. An activity permitted or regulated in one State may be restricted or prohibited in another. Consequently, determining whether a particular gambling or gaming activity is lawful requires consideration of the legislation applicable in the relevant jurisdiction.

The constitutional allocation also created difficulties when gaming activities moved into the digital environment. Unlike a physical casino or gaming house, an online platform can operate from one location while providing services to users located across multiple States or even outside India.

This territorial difficulty became particularly significant with the growth of online money gaming. The Parliament’s subsequent enactment of a national law specifically dealing with online gaming represents an important development in this area.

The Public Gambling Act, 1867

The Public Gambling Act, 1867 is one of the earliest statutes associated with gambling regulation in India. Its original objective was to provide for the punishment of public gambling and the keeping of common gaming houses.

The legislation defines a “common gaming-house” in relation to premises where instruments of gaming are kept or used for the profit or gain of the person managing or occupying the premises.

The technological advancement of gaming has raised a serious question about how concepts contained in traditional gambling statutes should apply to online platforms.

It is also important to recognise that the Public Gambling Act does not constitute a complete and uniform gambling code applicable to every State in modern India. Several States have enacted their own gambling legislation, while some have adopted or modified older statutory frameworks.

Thus, the legality of gambling cannot be determined only by referring to the Public Gambling Act. The relevant State law and the nature of the particular activity must also be examined.

India does not traditionally have a single uniform regulatory framework for all forms of gambling. Different states have adopted different legislative approaches. Some states permit certain games subject to regulation, while others restrict them.

Different games include casinos, horse-race betting, poker, rummy, fantasy games, and online games involving money.

Therefore, the legality of a gambling activity may depend upon where the activity takes place, how it is conducted and the legislation applicable in that State.

Game of Skill and Game of Chance

One of the most important concepts in Indian gambling jurisprudence is the difference between a game of chance and a game of skill.

A game of chance is generally understood as an activity where the outcome is substantially determined by luck or chance. Whereas A game of skill involves a significant degree of knowledge, judgment, strategy, experience or physical or mental ability.

Indian courts have historically treated games predominantly involving skill differently from gambling activities predominantly based upon chance.

However, the distinction is not always straightforward. Many games contain elements of both skill and chance. Therefore, courts have often examined which element is predominant rather than merely asking whether chance exists at all.

This distinction became particularly important in relation to activities such as horse racing, rummy and certain forms of online gaming.

Online Gambling in the Rise of the Digital Era

The growth of smartphones, digital payments and inexpensive internet access has transformed the Indian gaming industry.

Traditional gambling required physical participation, whereas online platforms allow users to participate remotely. This has significantly increased the accessibility and geographical reach of gaming activities.

Online platforms raised legal concerns about jurisdiction, Cross-border operations, advertising, financial transactions, data protection and enforcement.

These challenges demonstrated the limitations of relying exclusively upon legislation designed for physical gambling establishments.

Conclusion

Gambling law in India has undergone a significant transformation. Historically, the regulatory structure was primarily State-based and was strongly influenced by legislation such as the Public Gambling Act, 1867.

The emergence of online gaming challenged many assumptions underlying traditional gambling law. Digital platforms operate across territorial boundaries, rely upon electronic payment systems and can be accessed from virtually any location. These characteristics created regulatory issues that could not always be adequately addressed through nineteenth- and twentieth-century gambling legislation.

The enactment of the Promotion and Regulation of Online Gaming Act, 2025, followed by its enforcement from 1 May 2026, represents a major development in India’s approach to online gaming. The framework prohibits online money games and also addresses their ad advertising, promotion and financial facilitation, while simultaneously providing a regulatory structure for categories such as e-sports and other legitimate online games.

The future of these law in India will therefore depend upon how effectively traditional constitutional principles, State legislation and the new national online gaming framework operate together. Judicial interpretation will continue to play an important role in resolving questions of legislative competence and the classification of gaming activities.

Ultimately, the central legal challenge is not merely to determine whether gambling should be permitted or prohibited. It is to create a coherent regulatory system capable of distinguishing lawful forms of entertainment and competition from prohibited monetary gaming, protecting consumers, addressing technological developments and ensuring effective enforcement in an increasingly digital environment.
