RECENT JUDGEMENT OF FIRST WEEK OF JANUARY 2026

1. ARVIND DHAM v. DIRECTORATE OF ENFORCEMENT, 2026 INSC 12

This case discussed the right of speedy trial and held that when a case under Prevention of Money laundering comes in that scenario also prolonged pre-trail incarceration will amount to the violation of speedy trial given under Article 21. SC held that right of speedy trial is not affected by the nature of the offence and at the same time economic offences can not be seen as one class for not giving bail.

2. STATE OF UTTAR PRADESH V. ANURUDH & ANR, 2026 INSC 47

The HC power to grant bail under section 439 of CrPC,1973 is to be seen as narrow in its scope and also restricted to the prima facie cases and it should not be used as a mini trial.

3. GOLDEN FOOD PRODUCTS INDIA V. STATE OF UTTAR PRADESH & ORS., 2026 INSC 22

If a public auction happens in a lawful manner and even if the highest bid exceeds the reserve price, in that case the authority (auctioning) cannot cancel the auction merely having the expectation of getting a higher price in future. Therefore, absence of fraud, collusion and material irregularity will amount to violation and arbitrary to Article 14.

4. ROSHINI DEVI V. STATE OF TELANGANA & ORS., 2026 INSC 41

In case of preventive detention should be used only when there is very harsh and exceptional law and not just because bail was granted. When the normal law is there , it should not be used.
