While answering to a reference, the Supreme Court bench consisting of Justice Abhay S. Okha, Ahsanuddin Amanullah and Augustine George Masih delivered that permanent alimony and interim maintenance under the Hindu Marriage Act can be granted even when the marriage has been declared void.
The bench delivered that that the spouse whose marriage has been declared void under Section 11 of HMA act is entitled to seek permanent alimony and interim maintenance by invoking Section 25 of the HMA Act. They further stated that such relief under Section 25 is always discretionary.
