The Apex Court held that rules or eligibility for selection of candidates to public service could not be changed midway once the recruitment process commenced as it would violate the fundamental rights of inequality. This would apply to public service, both of the Union and States. The court also said that the recruitment process began with the issuance of the advertisement calling for applications and ended with the filing of the vacancies. The overall procedure of recruitment must be fair, transparent, non-discriminatory and non-arbitrary.
