The Apex Court noted that states punish accused persons awaiting trials by driving bulldozer into their homes and thus, indulge in a naked displace of “might is right” without sparing a thought for their families. The Bench invoked extraordinary powers under Article 142 of the Constitution to issue “binding directives” to make the public officials more accountable. This includes a 15 days prior notice of demolition to the occupants. The judgement followed petitions which had sought redress against states’ “bulldozer culture”.
